Overview
This document is a Privacy Policy. The following describes the terms
and conditions that govern the use of and access to all information
pertaining to users of http:www.bcbiogenics.com (“BCB Website”) as
applicable to all Products and Services made available (in any way,
shape or form) by BC Biogenics Pty Ltd (“BCB” or “we” or “our” or
“ours”) via the BCB Website. As such, the terms and conditions
outlined in this Privacy Policy also govern all other Products and
Services offered by BCB as stated either directly in this document
or indirectly by reference.
You must read and agree to the terms and conditions of this Privacy
Policy before being able to use and access restricted BCB Website
Products and Services and/or to gain the access to and use of any
other Products and Services made available (in any way, shape or
form) by BCB via the BCB Website. BY CLICKING ON THE APPLICABLE

AMENDMENTS THAT COME INTO AFFECT) ARE HEREBY INCORPORATED BY
REFERENCE INTO THIS PRIVACY POLICY. BY CLICKING ON THE APPLICABLE

As part of the normal operation of our business activities we
collect, use and, in some cases, disclose information about you to
third parties. This Privacy Policy governs the information we
collect about you and our use of the information you provide to us.
By accepting this Privacy Policy, you expressly consent to our use
and disclosure of your personal information in the manner prescribed
in this Privacy Policy. This Privacy Policy is incorporated into and
subject to the terms and conditions of our User Agreement applicable
to BCB Website (which can be found at http://www.bcbiogenics.com/user-agreement.htm).
As such, the terms and conditions outlined in this Privacy Policy
also govern all Products and Services offered by BCB via the BCB
Website as stated either directly in this document or indirectly by
reference.
Except as stated in other policies, agreements, information pages
and other general documents incorporated into this Privacy Policy by
reference, the privacy practices of this notice apply to your
Membership, to all Products and Services made available by BCB via
the BCB Website and to all other general business to consumer
related activities between you and BCB via the BCB Website. Further,
except as stated in other agreements and policies incorporated into
this Privacy Policy by reference, the privacy practices of this
notice also apply generally to our affiliates, subsidiaries and
joint venture partners' websites, products and services whose
specific privacy policies can be found on their own specific
websites or by other means made available by such parties. Our
affiliates, subsidiaries and joint venture partners operate under
similar privacy practices as described in this Privacy Policy and,
subject to the requirements of applicable law and, in the case of
Australia, the requirements of the Privacy Act 1988 (Cth) (“Privacy
Act”). We strive to provide a consistent set of privacy practices
throughout our global operations.

1. AN IMPORTANT NOTE ABOUT CHILDREN.
Children (persons under the age of 18 years) are not eligible to use
our services unsupervised and we ask that children do not submit any
personal information to us. If you are under the age of 18 years,
you can use this service only in conjunction with and under the
supervision of a parent or guardian.
2. INFORMATION WE COLLECT
Our primary purpose in collecting personal information is to provide
you with a smooth, efficient, safer and customised experience in
relation to the use of our websites. This allows us to provide
products, services and features that most likely meet your needs,
and to customise our products, services and features so as to try to
make your experience using our websites more smoother, efficient,
safer and easier. We only collect personal information about you
that we consider necessary for this purpose and to achieve this
goal.
To fully use our services, you may need to register using our online
registration form, where you will be required to provide us with
contact information and other personal information. You may also be
required to provide us with a username (“User ID”). Under some
circumstances we may require some additional necessary financial
information, such as and in order to, but not limited to: if you are
purchasing a subscription product/service or purchasing other
Products and Services using a credit card or if you are purchasing
other Products and Services via one of our other websites. We use
your financial information, including credit card information to
verify your name, address, and other contact information, as well as
to bill you for your purchases of our Products and Services.
We automatically track certain information about you based upon your
behaviour on the BCB Website. We use this information to do internal
research on our users' demographics, interests, and behaviour to
better understand and serve you and our community. This information
is compiled and analysed on an aggregated basis. This information
may include the URL that you just came from (whether this URL is on
the BCB Website or not), which URL you next go to (whether this URL
is on the BCB Website or not), what browser you are using, and your
Internet Protocol (“IP”) address.
We use data collection devices such as "cookies" on certain pages of
the BCB Website. Cookies are small files placed on your hard drive
that assist us in providing customised services. We also offer
certain features that are only available through the use of cookies.
We also use cookies to allow you to enter your Password less
frequently during a session. Cookies can also help us provide
information which is targeted to your interests. Cookies are stored
on your hard drive, not on the BCB Website. Most cookies are
"session cookies", meaning that they are automatically deleted at
the end of a session (that is, when you log off from a particular
service or when you completely close your Internet browser). You are
always free to decline our cookies if your browser permits, although
in that case you may not be able to use certain features on the BCB
Website and you may be required to re-enter your User ID and/or
Password more frequently during a session.
If you use a credit card to pay the fees we charge, we may collect
some additional necessary information, including, but not limited
to, billing address, credit card number and credit card expiration
date.
If you send us personal correspondence, such as emails or letters,
or if other users or third parties send us correspondence about your
activities or postings on the BCB Website, we may collect such
information into a file specific to you.
If you register for BCB Website Products and Services on another
website or use a website providing a service for BCB or a website
that helps facilitate your activities with BCB, that website may
provide personal information about you and your transactions back to
BCB. The same also applies to all non-internet based (also known as
“offline”) third parties.
3. OUR USE OF YOUR INFORMATION
We use personal information about you (including, but not limited
to, the information in the file we maintain about you, and other
information we obtain from your current and past activities on our
websites) to resolve disputes, troubleshoot problems, help ensure
safe transactions on our websites, and to enforce our User
Agreement.
You agree that we may use personal information about you to improve
our marketing and promotional efforts, to analyse site usage, to
improve our content and product offerings and to customise the
content, layout, and services of the BCB Website. These uses improve
the BCB Website and better tailor it to meet your needs, so as to
provide you with a smooth, efficient, safer and customised
experience while using our services.
You agree that we may use your information to contact you and
deliver information to you that, in some cases, is targeted to your
interests, such as targeted banners, administrative notices, product
offerings, and communications relevant to your use of the BCB
Website and other Products and Services made available by BCB. By
accepting this Privacy Policy you expressly agree to receive this
information. If you do not wish to receive these communications, you
may opt-out of the receipt of certain communications at any time by
logging in to Your Membership Information page (found at http://www.tdtseries.com/subscriptions/member.php)
and altering your Newsletter Subscriptions.
4. OUR DISCLOSURE OF YOUR INFORMATION
Although BCB uses industry standard practices to protect your
personal information, due to technical limitations, we cannot ensure
that all of your private communications and other personal
information will never be disclosed in ways not otherwise described
in this Privacy Policy. By way of example (without limiting the
foregoing), we may be forced to disclose information to the
government or third parties under certain circumstances (further
details of which are set out below in the "Legal Requests" section),
or third parties may unlawfully intercept or access transmissions or
private communications. Therefore, although we use industry standard
practices to protect your privacy, we cannot and do not guarantee,
and you should not expect, that your personal information or private
communications will always remain private.
As a matter of policy, we do not sell or rent any personal
information about you to any third party. However, the following
describes some of the ways that your personal information may be
disclosed, and by agreeing to this Privacy Policy you expressly
agree that your personal information may be disclosed by BCB in the
following ways:
a. Advertisers. We aggregate (gather up data across all user
accounts) personal information and disclose such information in a
non-personally identifiable manner to advertisers and other third
parties for marketing and promotional purposes. However, in these
situations, we do not disclose to these entities any information
that could be used to identify you personally. Certain information,
such as your name, email address, Password and credit card number
are never disclosed to advertisers;
b. External Service Providers. There are a number of services
offered by external service providers that help you use the BCB
Website. If you choose to use these optional services, disclose
personal information to the external service providers and/or grant
them permission to collect personal information about you, then
their use of your personal information is governed by their own
privacy policy. We may, for your convenience, provide some of your
personal information to the external service provider offering such
services. However, before we disclose your personal information to
an external service provider, you will have the opportunity to see
what data is about to be sent and have the ability to approve the
disclosure. To prevent our disclosure of your personal information
to an external service provider, you can decline such disclosures or
simply not use their services. Because we do not control the privacy
practices of these third parties, you should evaluate their
practices before deciding to use their services;
c. Internal Service Providers. We may use internal service providers
to facilitate our present and future services (such as search,
discussion boards and surveys) and therefore we may provide some of
your personal information directly to them. In some instances, the
internal service provider may collect information directly from you
(such as the situation where we ask an internal service provider to
conduct a survey for us). In these cases, you will be notified of
the involvement of the internal service provider, and all
information disclosures you make will be strictly optional. In all
cases, these internal service providers' use of information we
supply them is restricted by confidentiality agreements. If you
provide additional information to an internal service provider
directly, then their use of Your Information is governed by their
own applicable privacy policy;
d. Other Corporate Entities. We share much of our data, including
personal information about you, with our affiliates, subsidiaries
and joint venture partners that are committed to serving your online
subscription needs and related services, throughout the world, as
allowed by applicable law. The personal information we collect is
stored by BCB on its servers located in the United States. To the
extent that these entities have access to your information, they
will treat it at least as protectively as they treat information
they obtain from their other users. Our affiliates, subsidiaries and
joint venture partners follow privacy practices no less protective
of all users than our practices described in this Privacy Policy, to
the extent allowed by applicable law. It is possible that BCB, its
affiliates, its subsidiaries, its joint venture partners, or any
combination of such, could merge with or be acquired by another
business entity. Should such a combination occur, you should expect
that BCB would share some or all of your information in order to
continue to provide the service. You will receive notice of such
event (to the extent it occurs) as provided in Section 11 ("Notice")
and we will require that the new combined entity follow the
practices disclosed in this Privacy Policy; and
e. Legal Requests. BCB may lawfully disclose your personal
information for law enforcement or regulatory purposes. BCB
co-operates with law enforcement inquires and other third parties to
enforce laws, intellectual property and other rights. We can (and
you authorise us to) disclose any information about you to law
enforcement or other governmental officials as we, in our sole
discretion, believe necessary, appropriate or as otherwise permitted
under the Australian Privacy Act 1988 (Cth), in connection with an
investigation of fraud, intellectual property infringements, piracy
or other activity that is illegal or may expose us to legal
liability.
5. CONTROL OF YOUR USER ID AND PASSWORD
You are responsible for all actions taken with your User ID and
Password, including fees. Therefore we do not recommend that you
disclose your User ID and/or Password to any third parties. If you
choose to share your User ID and/or Password or Your Information
with third parties to provide you additional services, you agree
that you are responsible for all actions taken with your User ID
and/or Password and therefore you should review that third party's
privacy policy. If you lose control of your User ID and/or Password,
you may lose substantial control over your personal information and
may be subject to legally binding actions taken on your behalf.
Therefore, if your User ID and/or Password have been compromised for
any reason, you should immediately change your Password as detailed
in Section 6.
6. ACCESSING, REVIEWING AND CHANGING YOUR INFORMATION
Following registration, you can review and change the information
you submitted during the registration process, including:
a. your Password and email address. If you change your Password or
email address we may keep track of your old details;
b. your registered personal information such as (but not limited
to): name, company, address, city, state, post code, country,
primary phone number, secondary phone number, fax number and gender;
c. your credit card number and expiration date, and other financial
information (if this information is being stored on a database of
ours).
You must promptly update your personal information if it changes.
Changes to Your Information can be made at any time by logging in to
Your Membership Information page (found at http://www.tdtseries.com/subscriptions/member.php).
Upon your request, we will deactivate your account, contact
information, and financial information from our active databases. To
make this request, email us via our contact details (posted at
www.bcbiogenics.com/contact-us.html). Such information will be
deactivated as soon as reasonably possible.
We will retain in our files information you have requested to remove
in some circumstances, such as to prevent fraud, resolve disputes,
troubleshoot problems, assist with any investigations, enforce our
User Agreement and to comply with legal requirements. Further, such
prior information is never completely removed from our databases due
to technical constraints and the fact that we backup our systems.
Therefore, you should not expect that all of your personal
information will be completely removed from our databases in
response to your requests. However, such information will only be
available to select BCB personnel.
7. SECURITY
Your Information is stored on BCB’s server located in the United
States. We use industry standard efforts to safeguard the
confidentiality of your personal information, such as firewalls and
Secure Socket Layers. However, "perfect security" does not exist on
the Internet and, as such, “perfect security” should not be
expected.
8. NOTICE
This document may be amended at any time in our discretion by
publishing the amended terms at the specified Location. All BCB
Website users accept, without recourse, that it is their individual
responsibility to maintain understanding, familiarity and compliance
with this Privacy Policy, by keeping themselves up to date with
changes to this Privacy Policy as they are published at the
specified Location. Except as stated below, all amended terms and
conditions shall, according to whichever occurs first, automatically
be effective twenty-eight (28) days after they are initially
published at the specified Location or as of the next time you log
in to your BCB Website account. Unless your BCB Website account is
terminated before either of these occurrences, your continued use of
your BCB Website account will infer that you are in agreement with
all amended terms and conditions of this Privacy Policy. This
Privacy Policy may not be otherwise amended except in writing signed
by you and BCB. This Privacy Policy is effective on the earlier of
your registration date or 24th March, 2011 for new registering users.
